General Terms and Conditions of Website Use and of Sale of Prints
- The content of this website is copyright to Dawid Gabriel Hendrick Lotz. By using this site, or ordering products, you agree to and accept these terms and conditions. If this is infringed upon the necessary steps will be taken.
- From time to time the website may include links to other websites. These links are provided for your convenience and provide further information. They do not signify that I endorse nor that I have any responsibility as to the contents of the linked websites.
- By purchasing an image as a print You hereby agree that the print may only be used for personal use and may not be used for any commercial purposes including public display, exploitation, reproduction or syndication to third parties. Any such alternative use must be agreed with me in advance.
- You understand and accept that even if any item on the site is offered for sale it does not necessarily mean that it is available. I shall use reasonable endeavours to ensure that any unavailable items are marked accordingly but where items are not marked I reserve the right at my discretion not to process your order.
- Your items will be dispatched as soon as possible, to the person named on the Order Form. I will try my best to communicate either by a website post or directly if a delay is likely.
- I shall dispatch your goods in the appropriate packaging, by registered post or equivalent, at my own risk to the address provided to me on your order form. Please email me if you require courier delivery.
- You acknowledge that I am not responsible for verifying the authority of the signatory taking receipt of the goods.
- In the event of any damage to a product as a result of mishandling in transit then photo need to be taken of the package and the package opened at the framer and photos taken of the process in case there is damage of the print. If the print is proven to be damaged I will take this up with the shipping company using the images you’ve taken. Once I’ve given permission the print will need to be torn in multiple fragments and the process and proof thereof photographed and sent to me. I will send a replacement once I have checked the evidence. If it is not possible to send you a replacement, I will issue you with a full refund. Please contact me by email ([email protected]) within 7 days of receipt if transit damage has occurred. When you receive your order, as per the EU Distance Selling Directive, you have until the expiry of seven days of receipt to notify us.
- The above also applies to the return of non-faulty items, which for some reason you have decided not to keep. The goods must be returned in the same condition as they were originally dispatched and received by you. All items must be returned with tracking details.
- If items are returned, due to being faulty or damaged in transit or just returned, you will be expected to pay for the return of the goods, and any refund of this amount will be at the sole discretion of myself and will be credited to the original charged account within 30 days of receipt of the damaged items. Please return them to the supplied address along with a note of your details and the reason for return.
- High quality inks and papers, which have archival properties, are used but a guarantee as to longevity of prints unfortunately cannot be given. Instructions are on the website as to how to care for the prints.
- Although care is taken to reproduce the prints as accurately as possible images on the website might differ slightly in appearance due to monitor and display properties.
- Prints might have a copyright mark (left or right bottom corner) on them with a digitally imprinted signature unless a hand written signature is requested (usually better if on mount). Any prints, which do not have a copyright sign, still remain the copyright of the photographer.
- Limited editions will have a number on them.
- All prints are sold unmounted and unframed unless otherwise requested (or stated).
- Even after purchase any images bought as prints remain the sole copyright of the photographer.
- At a point on this website we may ask for your personal data, for example, name, email address and your location (country). If you choose to enter these details you agree you may be contacted by the administrators of the site about further news – this is the sole purpose of the data being kept. All data will be stored inline with Data Protection regulations.”
